Mission Statement

The Island County Prosecuting Attorney’s Office is dedicated to fulfilling its statutory and constitutional obligations to the citizens of Island County and the State of Washington. The office is committed to efficiently and fairly prosecuting those who commit crimes in Island County, providing exceptional legal advice and services to Island County’s elected officials and governing bodies, advocating for the constant improvement of the justice system, and setting the highest standards of professionalism and ethics for the practice of law in Island County.

Office Staffing and Caseloads

The Island County Prosecuting Attorney, Greg Banks, is supported by a team of eight deputy prosecuting attorneys and ten legal support staff.

The Criminal Division

The Criminal Division is the largest division in the office, with six deputy prosecutors and Prosecuting Attorney Greg Banks dedicated to prosecuting criminal cases. Four attorneys, including the chief criminal deputy, primarily prosecute felony level crimes and their appeals in Superior Court. This includes everything from drug offenses and burglary to sexual assaults and murder. One of these attorneys also handles juvenile cases, which includes all levels of criminal activity, as well as adult offender drug court. Three paralegals assist these prosecutors. Banks personally prosecutes the most serious cases and other cases of special interest. He provides guidance to junior attorneys as needed, depending on their experience and the issues involved. Banks oversees the prosecution of major cases.

Two deputy prosecutors handle the high volume of misdemeanor cases, including driving under the influence, misdemeanor domestic violence, Fish and Wildlife violations, and a wide variety of traffic offenses. These cases are heard in the Island County District Court in Oak Harbor. A single paralegal and other non-attorney staff assist with these cases.

All criminal units are also supported by a victim/witness coordinator, who ensures that crime victims and witnesses receive assistance in interacting with the criminal justice system. This skilled employee works closely with victims of all types of crimes to protect their rights, provide support during prosecutions, and help them recover from the effects of the crimes committed against them.

The Civil Division

The Civil Division provides legal counsel to Island County elected officials, department heads, and numerous county agencies and departments. As an in-house law firm for the county, the Civil Division works closely with clients to solve a wide range of legal problems by issuing formal written opinions and memoranda, providing general day-to-day legal advice, and handling civil litigation in which Island County is a party, whether as a plaintiff or defendant. Two deputy prosecutors and Banks provide civil legal assistance to the county, and two paralegals provide support to the attorneys in this division.

The Child Support Enforcement Division

The Child Support Enforcement Division provides services under contract with the State of Washington to enforce child support orders of absent parents when the custodial parent receives public assistance. This work is carried out by a full-time paralegal devoted to the caseload, who coordinates with Snohomish County prosecutors appointed as special assistant attorneys general on Island County cases. All expenses, including salaries and benefits, are reimbursed to the office by the State of Washington.
