GMA NOTICE OF ADOPTION
PURSUANT TO RCW 36.70A.290
THE GROWTH MANAGEMENT ACT

September 22, 2014 the Board of Island County Commissioners, through Ordinance

C-75-14 [PLG-006-14], adopted amendments to Island County Code and the Island County Comprehensive Plan necessary to update the County’s protection standards for Fish and Wildlife Habitat Conservation Areas. This effort added a new section to Island County Code (17.02B ICC) and amended Titles III, XVI, and XVII ICC.

A State Environmental Policy Act (SEPA) Determination of Non-Significance (DNS) was issued for this action by the Island County SEPA Responsible Official on April 25, 2014.

Any appeal of the above action alleging non-compliance with the Growth Management Act & SEPA must be commenced by filing a petition with the Growth Management Hearings Board.  The petition must be filed no later than 60 days after the date of this publication and shall be filed in accordance with the procedures set forth in RCW 36.70A.290.

Island County Fish and Wildlife Habitat Conservation Areas Update

 

This proposal will involve the following components: (1) amendments to the Island County Comprehensive Plan concerning fish and wildlife habitat conservation areas, (2) revisions to Island County Code necessary to protect fish and wildlife habitat conservation areas; and, (3) changes to the County Environmental Policy related to categorical exemptions in critical areas.

This is a non-project action which applies to all unincorporated areas of Island County not subject to the jurisdiction of the Island County Shoreline Master Program.

Final Environmental Impact Statement (FEIS) for the Island County GMA Comprehensive Plan, September 1998.

This document was used to consider environmental impacts associated with the initial adoption of the Island County GMA Comprehensive Plan in 1998. It has also been used to inform subsequent updates and amendments to this plan and associated implementing regulations.

The FEIS for the Island County GMA Comprehensive Plan evaluated significant adverse environmental impacts and alternatives related to the adoption of a revised comprehensive plan and implementing development regulations. Because this document considered environmental impacts associated with comprehensive plan policies and development regulations designed to protect fish and wildlife habitat conservation areas, and because Island County is proposing to substantially revise these policies and regulations, this document is being incorporated by reference.

The lead agency for this proposal has determined that this amendment does not have a probable significant adverse impact on the environment.  An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c).  This decision was made after review of a completed environmental checklist and other information on file with the lead agency.  This information is available to the public on request.

 

Commenting:

 

This DNS is being issued using the integrated SEPA/GMA process identified in WAC 197-11-340. Public comments will be received for a sixty day period following the issuance of this determination. This determination was issued April 25, 2014; therefore, comments must be submitted by June 23, 2014.

 

Appealing this determination:

 

Pursuant to ICC 16.19.190.B.2 a SEPA threshold determination issued for a Type IV legislative action that is initiated pursuant to Chapter 36.70A RCW may be appealed to the Hearing Examiner within 14 days following completion of the public comment period.  An appeal shall be accompanied by written statement of appeal and the applicable fee pursuant to the fee schedule adopted by the Board.  Appeals may be filed by a County Department or any aggrieved person.  A more comprehensive statement of appeal setting forth in detail alleged errors and/or the basis for appeal must be submitted by the appealing person or Department within 30 days following completion of the public comment period, or the appeal is not properly filed and will be dismissed by the Hearing Examiner.

Description of current proposal:  

Amendments to Chapter 17.03 ICC, designating land use application types, definitions and establishing development standards for the regulation of I-502 (recreational marijuana) uses in several zones of the County.

The lead agency for this proposal has determined that these amendments do not have a probable significant adverse impact on the environment.  An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c).  This decision was made after review of a completed environmental checklist and other information on file with the lead agency.  This information is available to the public on request.

This DNS is issued under WAC 197-11-340(2).  Comments must be submitted by March 10, 2104.  Following the close of the comment period the lead agency will evaluate public comments which will be evaluated for the purposes of retaining, revising or withdrawing the DNS.
